These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

1.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.
1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.

Website uptime

1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.
1.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Shipping

1.16 Your order will be processed and delivered without undue delay, no later than 30 days after your order has been placed.
1.17 Please allow for up to 7 working days for delivery following the dispatch of your order.
 1.18 If your purchased item was damaged in-transit to you then you must notify us within 24 hours of taking delivery of the item. Please thoroughly inspect your item(s) as soon as they arrive with you. 

Cancellations, returns and refunds

1.19 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
1.20 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.
1.21 To meet the cancellation deadline, please notify us via email or phone about cancelling the order before the cancellation period has expired.
1.22 If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.
1.23 We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
1.24 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.

1.25 Orders cancelled because you have changed your mind or the item is no longer required will be refunded in full minus any carriage paid.

1.26 You will not have any right to cancel an order for the supply of any of the following goods:
(a) the supply of goods that are made to the customer's specification or are clearly personalised.
(b) the supply of goods that are liable to deteriorate or expire rapidly.
(c) special orders (you will always be notified of a special order before purchase)

1.27 In addition you will lose your right to cancel if you:
(a) unseal goods that are not suitable for return or return goods not fit for resale.
(b) combine goods with other goods after delivery so that they become inseparable.
(c) fit the goods to your vehicle or assemble the goods making bolt impressions or otherwise changing the condition to used.

Refunds on Cancelled orders
In line with the PayPal March 2020 refund policy update; Cancelled orders will be refunded less 2.5% to cover the non-refundable transaction fee on all PayPal and card payments.

Products and stock levels

All items are subject to availability. All of our stock levels are live, but obviously errors can occur in our warehousing stock control systems. We will inform you as soon as possible if the goods you have ordered are not available. Products and packaging are subject to change or substitution without prior notice. Every effort will be made to dispatch the items specified.

Incorrect orders

In the unlikely event the item you received is not what you originally ordered, please contact us via sales@rhdperformance.co.uk and quote your order number, your name and address, details of the product, reason for return, and whether you require a refund or a replacement. We will then advise on how to proceed with the return. You must inform us within 24 hours of delivery if your order is incorrect. 

International Orders

For shipping overseas (outside of the UK) we will contact you on receiving your order (and prior to processing it) to quote for shipping charges and times.

Liability

Performance goods are supplied for specialist use and usually alter the vehicle from manufacturers' specification. They can be subject to extreme use when compared to the usual goods that we supply ("Performance Goods"). The life expectancy and durability of Performance Goods can differ to standard goods depending on the item, and therefore you should note that a claim for failure or wear of the Performance Goods shall not be entertained by us. Any warranty claims sought in relation to Performance Goods shall be strictly subject to the manufacturers' warranty terms for such items. It is also important that you know if an item falls into the category of Performance goods, for example uprated exhausts/suspension/air filters/performance brake parts. If you are unsure it is your responsibility to seek advice.

No liability shall be accepted by us where you attempt to modify or install Performance Goods where it is known or ought reasonably to be known by you that the Performance Goods have been incorrectly supplied or otherwise not in accordance with your order. Further, due to the stress that is placed on connected parts to which the Performance Goods are supplied, we strongly recommend that specialist advice from our experts is sought prior to purchase to ensure the Performance Goods are satisfactory for your vehicle. It is also recommended that you gain advice from a specialist garage to ensure the item purchased is suitable for your vehicle or planned use.
In the event that you purchase any Performance Goods, you must ensure that you are aware of the following:
Performance Goods and any modifications to your vehicle may render your motor vehicle insurance to be invalid, and may also invalidate any vehicle warranty cover you may have. We bear no responsibility on any failure by you to advise your insurers or warranty providers, or for the invalidity of such policies;

a) Some Performance Goods are designed solely for track and race use, and it is your responsibility to ensure any alterations made to your vehicle are compliant and in accordance with legal and regulatory requirements in the UK or the country in which you use such vehicle;
b) Performance Goods and any modifications to your vehicle may adjust the emission output of your vehicle, and it is your responsibility to ensure that any alterations made to your vehicle are compliant with the legal and regulatory requirements for emission in the UK or the country in which you use such vehicle.
c) It is your responsibility to ensure that any Performance Goods applied to vehicles or any modified vehicles on public roads are legal, safe and compliant with UK regulatory requirements for use on public roads.
d) RHD Performance Limited accepts no liability for any financial costs, labour, workmanship, or repair relating to products fitted, supplied by RHD Performance Limited. 

Price Matching

RHD Performance seek to Price Match products where possible for our Customers. If you see a product cheaper and would like us to match the price, simply get in touch. Conditions for Price Matching are:

a) Product must be advertised for sale on a UK VAT Registered Company's own website (eBay, Amazon and other online marketplaces won't be considered for Price Matching).

b) The price must be displayed in GBP.

c) The price being matched must include all taxes (inc VAT), Shipping and Handling charges as applicable.

d) Typographical errors will not apply. 

e) Product must be readily available and not a Special Order Item.

f) Product must be in New Condition. Used, Refurbished, Open-Box, Ex-Display or Obsolete Stock items won't be considered for Price Matching.

g) Any Price Matching transaction will be at the discretion of RHD Performance Limited. We reserve the right to withdraw our Price Matching offer at any time.

Fraud Notice

RHD Performance Limited take Internet Fraud and Cyber Crime very seriously. RHD Performance have been subject to direct and attempted fraud on multiple occasions; this will not be tolerated. We have adopted very strict but basic terms to protect RHD Performance against fraud:

a) All orders will leave our premises carefully packed and sealed. Before signing for your item it is extremely important your package is thoroughly inspected. If your order arrives opened, damaged or tampered with you must sign for the goods as damaged. 

b) Any incorrect items within your delivery must be reported to us within 24 hours of signing for the consignment.

c) Any missing items within your delivery must be reported to us within 24 hours of signing for the consignment.

Law and jurisdiction

These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
